FOI request for USS consultation response

This legal advice was commissioned by UCEA in respect of a freedom of information request being made in relation to the 2014 USS valuation employer consultation. The advice may still be helpful for HEIs should they have to consider a freedom of information request regarding employer responses to UUK on the 2017 USS valuation.

Senior staff salaries

In a tribunal judgement published on 2 October 2014 King’s College London partially succeeded in its challenge against a decision notice from the Information Commissioner earlier in the year which ordered King’s to ‘disclose the specific job titles, departments and salary bands for staff earning above £100,000.’

King’s relied on two exemptions of the Freedom of Information Act to refuse the request; Section 40(2) and Section 43(2).
