This workshop will examine, from an immigration perspective, how to recruit staff from overseas. It will be of benefit to all staff responsible for staff immigration and will be facilitated by Graeme Ross, an experienced Immigration and Compliance practitioner at the University of Cambridge, together with Simon Kenny, Principal Associate at Eversheds Sutherland.

Together they will give hints and tips on how to deal pragmatically with a range of scenarios as well as highlighting relevant legal issues. Examples of some of the areas to be covered are:

An overview of the various immigration routes available for international staff coming to work at an HE institution.

  • The key rules applying to Tier 2 sponsorship, including restricted and unrestricted Certificates of Sponsorship, the Resident Labour Market Test, English Language requirements, maintenance, skill level, salary rates and periods of stay.
  • Employing other individuals subject to immigration control such as students under Tier 4.
  • Reporting and record keeping duties with which institutions must comply.
  • UKVI audits and areas of particular interest to UKVI.
  • Recent developments including English language testing and the healthcare surcharge.
  • The duty to prevent illegal working.
  • Suspension, downgrade and revocation of sponsor licence – what does this mean and how can it be avoided?
  • The new Tier 2 30k 'experienced' minimum salary rate
  • Immigration Skills Charge.

The session will also provide guidance on the latest April Immigration Rule changes.

A timed programme can be found below.

The day will run between 10.30am and 3.30pm (registration from 10.00am).

The content will be pitched at a level that will suit both experienced practitioners and ‘new starters’, so it will serve both as a ‘health check’ for those already working in this area and as an introduction for those who are new to this area.
