Collective consultation for redundancy

Redundancy consultation period and fixed term contracts

On 6 April 2013 the 90-day consultation period reduced to 45 days.

In addition, the termination of fixed term contracts that have reached the end of their stated term are excluded from the obligation to be included in the count for collective redundancy consultations.

The sector consultation response that contributed to the decision to change the regulations can be viewed in the Sector Consultations section of the UCEA website.

UCEA Update 12:090 summarises the Government response to that consultation.

JNCHES Guidance on Fixed term Contracts

JNCHES Fixed-Term and Casual Employment Guidance for Higher Education Institutions was published in 2002 in the lead up to the implementation of the fixed term employment regulations.

Most of the document has currency in terms of advocating good practice. However, equalities legislation referred to in the document has been superseded by the Equality Act 2010 and there is now an exemption in place that excludes fixed term contracts from the collective consultation regulations.
